The Marion City Council voted May 11 to approve several tax-increment financing (TIF) actions, including an agreement with Brynn Lane Properties LLC and a housekeeping amendment aligning older TIF agreements with star bond statute requirements for RCSZ Properties LLC and Marion Center Project LLC.
Mayor Absher introduced the item for Terrence Henry, noting that the agreements “precede your time in employment with the city” and that the release being requested would accelerate payout but yield less total money than waiting for scheduled disbursements. He said the arrangement was “in the best interest of the city from a financial standpoint” while acknowledging the optics of a city employee requesting an early cash-out.
Commissioner Barwick raised a caution about precedent: “My concern with this whole thing, are we opening a box where people that are in these TIF districts say, ‘Oh, I didn't know I could cash out early,’ and we were flooded now with everybody wanting to do this,” arguing that the city might later have to decline similar requests for fiscal reasons. Cody, speaking for staff, summarized financial impacts and the timing of remaining TIF years.
Terrence Henry, who was identified in the meeting as present in the audience, responded affirmatively when the mayor explained the mechanics and said he remained in favor of moving forward. After discussion and clarification, the council moved, seconded and approved the release on roll call.
The council also passed a technical second amendment to the North Commercial TIF Redevelopment Agreement to resolve conflicts with the star bond statute; staff described that ordinance as housekeeping to align prior agreements with current law. Council members instructed staff to continue providing clear summaries of financial effects when considering early releases or other nonstandard TIF actions.
Next steps: Finance and Economic Development staff will process the payout and finalize amended agreements as approved by the council.
