County counsel said the appeal presented a novel legal question about whether the repose statute applied to government suits; the Supreme Court ultimately agreed with the trial and Commonwealth Court decisions that the statute barred the county’s claim. Officials told the board the appeal was pursued without any additional cost to the county’s general fund, and the county used outside counsel to pursue the argument.
Commissioners thanked the staff and counsel for pursuing the issue and noted that the decision ends the county’s litigation opportunity on this matter.
