Staff noted that temporary outdoor sales are allowed for up to 90 calendar days without a conditional use permit; the applicant seeks an authorization that would exceed that timeframe, triggering the conditional use review. Drager also described the proposed removable fence panels (not mounted to the ground), said the applicants operate a similar serving area elsewhere without security incidents, noted that the sidewalk in front of the site was recently replaced by the applicants, and reminded commissioners that building owners would be responsible for supervising the area and following permitted serving times.
Chair opened the hearing, called for speakers three times, and, with no members of the public speaking, closed the hearing. Drager said the item will return to the Plan Commission in two weeks for additional review and potential action; that subsequent meeting will not include another public hearing but will be limited to commission review, discussion and action.
