The Wabasha County Board of Commissioners approved a Conditional Use Permit for an adult foster home on parcel R14.00309.00 in the Town of Plainview at its Feb. 7, 2023 meeting. The applicant was identified in the record as Jamie Ratz.
Why it matters: the permit allows the operation of an adult foster care home subject to county and state health and safety regulations; the board and Planning Commission attached conditions to ensure compliance with licensing, building code, access and environmental requirements.
The Planning Commission held a public hearing and recommended approval (vote 5'0'0'0'''''' recommended in the minutes). The board agreed with the Planning Commission's findings and approved the Conditional Use Permit subject to conditions that the record lists as follows:
1. The Conditional Use Permit is granted only for an adult foster care home on parcel R14.00309.00. 2. The project shall proceed only in accordance with the submitted plans and specifications or as outlined in the conditions. 3. A copy of the Minnesota Department of Human Services license required to operate an adult foster care home must be supplied to Planning & Zoning prior to issuance of a Building & Land Use Permit; copies of subsequent licensure renewals must also be provided. 4. The applicant must coordinate and pay for an inspection by the county's contracted building code inspector to determine compliance with the State Building Code, the State's ADA accessibility code, fire code requirements and other applicable codes. 5. There shall be no parking along County Road 4. 6. The applicant must bring the business into compliance with Sections 4.1 & 4.2 of the Rural Address Ordinance and bear costs of new street and address signage if required. 7. An E911 address must be obtained from Wabasha County prior to issuance of a building permit. 8. If construction disturbs more than 1 acre of soil, a construction stormwater permit must be obtained from the Minnesota Pollution Control Agency and a copy provided to Wabasha County. 9. A septic system permit must be approved prior to issuance of a Building & Land Use Permit.
The board recorded the Planning Commission's review of findings of fact and public testimony and adopted the CUP with the listed conditions by unanimous vote. The minutes do not record further conditions or a special timeline for compliance beyond the prior-to-permit requirements noted above.
What remains: the applicant must provide DHS licensure and other permits to Planning & Zoning and obtain required inspections and addresses before building or land-use permits will be issued.
