Council reviews Idaho code, timeline for filling mayoral vacancy

RATHDRUM — City counsel explained how the city will fill its vacant mayoral seat under Idaho Code §50-608 and answered council questions about timing and procedures.
"This is governed by Idaho code 50-608," counsel said, explaining that during a vacancy the president of the council may exercise the office of the mayor, carrying out executive duties such as running meetings and signing approved contracts and ordinances. Counsel added that the president remains a council member and retains a legislative vote while performing those duties.
Counsel said the president of the council nominates a replacement; the council then votes to confirm or reject that nomination. "The nomination can be a member of existing council or an individual that is not on council," counsel said, noting that any appointed mayor would serve until the next general election in November 2027.
Council members pressed for clarification about whether an appointee must run in 2027. Counsel corrected a misstatement and noted that the position will be on the ballot but the incumbent appointee is not required to run. Council members also discussed the procedure for filling a resulting council vacancy if a councilor is appointed mayor: the newly seated mayor would nominate a replacement for that council seat, subject to council confirmation.
Counsel and councilors said staff will return with any additional legal clarifications and that further discussion will occur once all council members are present. No formal nomination or vote on a candidate took place during the meeting.
