The Danbury Zoning Board of Appeal voted Jan. 9 to approve application 24-21, allowing a reduced side-yard setback to permit a two-car garage at 19 West Pine Drive.
Applicant Bruce Latin appeared and said he is requesting a side-yard setback reduction because his lot is undersized for the RA-40 zone (he reported 22,450 square feet, below the 40,000-square-foot standard). Board members discussed whether to require detailed floor plans before granting the variance but agreed the primary question was the impact of the proposed box on the lot and neighbors.
A board member who moved the motion said the hardship stems from characteristics of the site that were not created by the applicant and noted the lot’s odd shape and undersized square footage. The board also cautioned that granting a variance is a permanent change to the property’s zoning rights. The motion to approve the reduced side-yard setback from 25 feet to 15 feet for a two-car garage was made, seconded and approved by voice vote; action was recorded as approved “per plan submitted.”
Next steps: the approved variance allows the applicant to proceed with building-permit and zoning-review processes; other required health, building and engineering reviews will proceed separately.
