Aurora staff recommends opposing state bill to expand administrative lot splits

Aurora City staff told the legislative committee they will oppose HB261308, legislation that would let property owners split lots of 2,000 square feet or larger through an administrative approval process without local infrastructure and planning review.
Liz told the committee the city already allows limited administrative subdivision under local code and that the state bill would override home-rule authority and remove assurances that new lots conform to the comprehensive plan, land-use codes, infrastructure capacity and public-safety needs. "We already allow for administrative subdivision of land... we do believe again this would be a violation of our home rule authority," Liz said.
Legal counsel Lena confirmed an additional mortgage-notification requirement in the draft would be new to Aurora’s code: "We do not have that requirement in our code currently. That would be new in the bill. And the bill would put that onus on the city to track that." Committee members debated the operational burden and agreed to support staff’s opposed position.
Staff will convey the city’s opposed position to the bill sponsor and track any amendments that address Aurora’s infrastructure and home-rule concerns.
