The New Kent County Board of Supervisors on May 11 approved a conditional use permit to operate an assembly hall and event venue at 17701 Polishtown Road, subject to staff‑recommended conditions and an amended sunset of three years.
Patrick Silva, principal planner, told the board the applicant proposes a 10,000‑square‑foot event building on a 48.5‑acre parcel with a 50‑space gravel parking lot. "Events would take place within a proposed 10,000 foot event space located on the subject site," Silva said, and staff recommended conditions on hours of operation, attendee limits, site maintenance, and a sunset clause to ensure the use commences promptly.
The planning staff noted technical requirements that will be addressed at site plan: fire sprinkler requirements for assembly uses over 5,000 sq ft, wetlands and stormwater/erosion controls, and required trip‑generation data. Silva said staff would require a recorded shared‑entrance agreement if the commercial entrance is shared with adjacent parcels.
Supervisor discussion focused on enforcement and neighborhood notice. Some supervisors questioned whether the five‑year sunset in the staff report was too long; the board adopted an amendment setting the CUP to expire after three years if a certificate of occupancy has not been issued.
The motion to adopt resolution R‑18‑26 (granting CUP‑01‑26) with the three‑year amendment carried on a roll call vote (one member recorded a 'no' vote). The resolution as approved requires the applicant to satisfy the conditions in the staff report (site plan approval, environmental/wetlands review as necessary, building and fire code compliance) before operations may begin.
Next steps: The applicant must complete required site plan and permitting steps, address building and environmental conditions, and secure a certificate of occupancy before the three‑year sunset date to avoid automatic expiration.
