Chambers County commissioners on May 15 tabled consideration of a petition to partially abandon a 6-foot unimproved right-of-way along Third Street between Avenue E and north of Avenue G after public commenters warned the closure would remove essential access to pasture and small parcels.
Robert H. Kayla testified that the right-of-way provides primary access to pasture land his family has used since 1935; he said abandonment would require hauling livestock by trailer around a circuitous route and could effectively cut off access to some parcels. County staff reported they had notified adjacent property owners and learned two small parcels would be landlocked if the abandonment were approved.
Commissioners said they were concerned about inadvertently denying legal access or creating undue burdens and asked petitioners to provide more information, including whether they intend to develop the property with a new improved roadway that could restore access. The court agreed to table the item and asked staff to ask petitioners to work with affected owners; the item may return to the court in about two weeks if the parties provide a solution.
The court did not vote on the abandonment at this meeting.
