Commissioners approve single-property-line designation to enable Flash Metals testing at county landfill site

Chambers County commissioners voted May 15 to approve a single property line designation between Flash Metals USA and the Chambers County Solid Waste Department that county staff said will enable Flash Metals to petition the Texas Commission on Environmental Quality (TCEQ) to permit R&D testing at an on-site building.

Blaine Nicks, representing Flash Metals, described the request during a public hearing and said the designation is needed because a building used for testing lies within distance limits to an off-site receptor under the company—s existing permit-by-rule. County environmental consultant Abishek (GHD) explained that the designation would treat the two adjoining parcels as a single property only for air permitting purposes; it would not change ownership or other property rights.

County staff asked that some matters (including a revised lease or contract language) be discussed in executive session with attorneys before formal action; after that executive session the court returned to open session and approved the designation by voice vote (one commissioner recorded opposition during the post-exec motion). The court instructed staff to involve legal counsel and the landfill office in preparing the formal agreement and to proceed with the TCEQ petition if the agreement is finalized.

The public record shows the court approved the single-property-line designation for the purpose stated; staff said the designation is limited to air-permitting considerations and that Flash Metals will continue to comply with applicable safety and permitting requirements.
