The North Ogden City Planning Commission on the recommendation vote Monday forwarded a 10-lot minor subdivision at 1075 East Jake Drive to the city council, conditioned on engineering and technical-review requirements and documentation of trail connections.
Staff said the 71-acre site lies in an HP3 hillside-protection zone that requires extra geotechnical review and a 150-foot rear-yard setback. Scott Hess, the staff presenter, told commissioners the developer seeks flexibility from some standards because the subdivision will use a private drive on steep terrain. "The recommendation is that the development agreement instead measure house height solely from the average grade at the building footprint," Hess said, adding staff proposed a 35-foot maximum at that measurement point.
Staff described several requested deviations that would be memorialized in a development agreement: a lot-specific reduction in rear-yard setback for one constrained lot, allowance for detached accessory dwelling units placed outside the traditional rear-yard location when required by topography and utility constraints, and an exception to the city's normal block-length maximum for a private roadway if the fire marshal and city engineer approve road and turnaround design. Utilities inside the subdivision will be private and the preliminary plat would vacate a previously dedicated 200-foot segment of Jake Drive, reverting the roadway beyond that point to private ownership; staff will require utility vacation letters or follow Utah code procedures if necessary.
Developer representatives said grading, building envelopes and fire-marshal access largely dictate house locations. Janiva, speaking for the developer, said the project anticipates a gated community and a fire-protection buffer around the property, adding that homes of the proposed size will be sprinklered. "We were just going to follow that as the trail to get around the property," Janiva said when describing the fire barrier and the proposed boundary for trails.
Commissioners pressed staff to make trail modifications explicit. Staff said the development agreement should include a trail-connection map so the council and public can see which user-created paths will be preserved or rerouted into public utility easements. The commission adopted the staff recommendation and added a requirement for a trail map and the technical conditions listed in the staff report.
Motion and next steps Commissioner Green moved and Commissioner Swanson seconded the motion to recommend approval of the minor subdivision, development-agreement elements and the partial Jake Drive vacation, conditioned on the staff report and inclusion of a trail-connection map. The commission voted unanimously to forward the recommendation to city council for final action.
Implementation details and clarifications Staff said escrows posted to allow current building permits would be refunded if the street vacation proceeds and that final plat approval requires physical, annexed water supply pursuant to the city's will-serve rules. Garbage service arrangements for the private subdivision were not finalized and were described as either private contract service or centralized pickup; the commission asked that maintenance and service responsibilities be clearly documented in HOA or development-agreement materials.
The commission's recommendation is advisory; the city council will consider the development agreement and subdivision plat at a future meeting.
