Commission adopts hearing order in Choron appeal after attorney arguments; executive sessions yield no action

The body then introduced the Choron appeal and heard preliminary motions of counsel. The commission again recessed to executive session at 10:45 a.m. for consultations with counsel; the motion to recess was made by Commissioner DeLord and seconded by Commissioner Bodisch, and the three commissioners again recorded aye votes. The commission reconvened at 12:37 p.m.; the minutes again state that no action was taken in executive session.
Following the second reconvening, the commission considered a Hearing Order. Commissioner Robert Bodisch moved to adopt the Hearing Order; Commissioner Michael Lummus seconded the motion. The Hearing Order, as read into the record, granted the appellant’s request for a continuance and issued an order resolving a discovery dispute. The motion carried with Commissioners DeLord, Bodisch and Lummus voting aye.
No further substantive action on the appeal was recorded in open session. The commission adjourned at 12:44 p.m.
The meeting minutes identify counsel for the Sheriff’s Office and counsel for the appellant among those present, and list the appellant as Rachel Choron. The minutes also record that the commission reserved the right to meet in executive session under Chapter 551, Subchapter D, Texas Government Code.
