Planning commission backs homeowner variance for unpermitted motorcycle shed

The Austin City Planning & Zoning Commission on Tuesday recommended that City Council grant a variance to John and Christy Luna to retain an added metal shed and other detached accessory buildings at 10423rd Avenue Southwest.

Planning staff told the commission the property contains three previously existing sheds and a detached garage plus a later 18-by-12-foot metal shed that was added without a permit; the total detached accessory area is 1,236 square feet, exceeding the city code threshold of 1,200 square feet for parcels under one acre. Petitioner John Luna told the commission the new metal shed is “for my motorcycle,” and said three other sheds predated annexation.

The staff report outlined the variance standards commissioners must weigh — harmony with the zoning ordinance, consistency with the comprehensive plan, reasonable use of the property, the existence of unique circumstances not created by the landowner, and no alteration of the locality’s essential character. Commissioners discussed whether the property’s annexation history and preexisting outbuildings supported a variance and weighed options short of approval, including requiring the structure be permitted to code, attaching the structure to the house, or removing an existing outbuilding to meet the two‑structure limit.

Commissioner Bartley moved to recommend approval to council; the motion was seconded and passed by voice vote. Staff said the commission’s recommendation will go to City Council for final action at an upcoming meeting.

The commission’s action is advisory; Council will make the final decision on the variance request.
