Shelby council approves acceptance of Lamb subdivision streets, invokes emergency to speed recordation

Shelby City Council voted to adopt Ordinance 20-2024, accepting and confirming for public use the streets and utility rights in the Lamb subdivision and declaring an emergency to suspend the ordinance’s three-reading requirement so county signature and recordation can proceed.

Councilmember Martin moved for passage with a second by Mr. Roberts. During discussion Martin said the Planning Commission had approved the subdivision plan and noted a sanitary sewer would be routed so it would not tie into the city’s collection system. He also explained that stormwater retention areas will remain privately maintained under a developer agreement and, once lots are sold, maintenance responsibility will transition to homeowners rather than the city.

Mayor and public works staff described that the ordinance will formalize right-of-way lines (bringing property lines back to the center of the road) and establish locations for utilities. Council briefly noted two existing structures on the property and confirmed those will be addressed as part of the subdivision recordation and lot configuration.

The clerk called the roll for the motion to suspend the three-reading rule and again for final passage; the roll-call votes recorded the listed councilmembers voting in favor and the measure passed. The ordinance authorizes the mayor to execute required documents to forward the dedication to county recorders and take steps to implement the utilities and right-of-way dedications. No amendments were recorded on the floor.

Next steps: city staff will forward documents to the county for signatures and complete recordation; the council directed staff to ensure maintenance agreements for stormwater are documented in the developer’s final plat and related agreements.
