Sanitary board approves Amendment No. 1 to Bowen guaranteed-savings contract, citing IDEM projects

The Board of Sanitary Commissioners voted May 13 to approve Amendment No. 1 to the guaranteed savings performance contract with Bowen Engineering, specifying project tranches required under Indiana Department of Environmental Management (IDEM) directives and correcting an attorney's scope typo to designate the work as Phase 2.
The amendment breaks out projects under a previously authorized $140,000,000 top-end authorization and identifies work including a County Road 350 North sewer replacement (following recent emergency repairs), demolition of a decades-unused primary clarifier at the treatment plant and upgrades to the Jakes Creek Lift Station. Chair (speaker 2) said the primary clarifier has been out of service “about 26 years” and is in poor condition; demolition will free plant space for future improvements and staging.
Chair said the Jakes Creek Lift Station, which serves the south and east sides of Muncie, moves roughly 700 gallons per minute up to 3,000 gpm and has had extensive maintenance over the past three years; an upgrade is now due and is expected to be among the final major lift-station projects under this program. The amendment also includes a $375,000 miscellaneous project allowance to start work on CSO 37 and cover minor plant repairs, concrete work and other small items that are difficult to price individually.
During public comment, Rick Henser, who introduced himself as a newsman and author from Muncie City, asked whether the general contractor uses union labor or local subcontractors and asked for clarification of any extension or contract changes. Chair responded in the meeting that Bowen is a union contractor that "does use the local labor hall" and that Bowen had been competitively bid (the chair noted Bowen was the only respondent this round because only three contractors in the state can do guaranteed-savings contracts under state law).
The chair moved to approve Amendment No. 1 and a commissioner seconded; the board approved the measure by voice vote. The board also approved a register of claims earlier in the meeting. The transcript records two slightly different totals for that register ($1,419,637.23 when introduced and $1,419,006.37 when recorded as approved).
