The Wythe County Board of Supervisors voted Feb. 24 to adopt Resolution 2026‑02 requesting that local election officials not begin early voting for a proposed constitutional amendment until the 90‑day constitutional waiting period following final passage of the General Assembly has expired.
The resolution, read into the record by Deputy County Administrator Matt Henkins, cites Article 12, Section 1 of the Virginia Constitution and notes that the 90‑day period following final passage on Jan. 16, 2026, expires April 16. The measure asks the general registrar and electoral board to withhold early-voting preparations for the special election while a Tazzle County Circuit Court order (case CL26‑266) is unresolved and until the Virginia Court of Appeals or Supreme Court issues further direction.
Board members debated the legal scope of the resolution and several supervisors asked for additional consultation with the county attorney before finalizing language. The board placed legal consultation on the closed-session agenda and later certified the closed meeting.
On the roll-call vote to adopt the resolution the board recorded five votes in favor and two opposed; the resolution was approved.
One supervisor who opposed the resolution expressed concern about potential overreach and requested more consultation with legal counsel before taking formal action; the speaker did not ask to block implementation of any election the registrar already deemed permissible.
The resolution will be transmitted to the Virginia State Board of Elections and the Office of the Attorney General as stated in the text. The board said the action was intended to preserve the county's compliance with the state constitution pending authoritative judicial determination.
