"The section establishes a formal process for Jefferson County to accept older, privately maintained subdivision roads into the public road system," Gunter said.
Gunter also described amendments to the utilities language: public utilities and private utilities under the Alabama Public Service Commission's purview must hold right‑of‑way use agreements and meet conditions, and utilities that damage roads will be required to repair them. Commissioners asked whether cost‑sharing or reimbursement mechanisms exist; staff said the process includes issuing a list of deficiencies and that homeowners' associations or private owners must address major repairs before acceptance.
The commission voted to approve the amendments to article four (sureties for completion and maintenance of improvements) and article six (eligibility for occupancy of county right‑of‑way). Staff said the changes are intended to facilitate permitting, protect county roads from damage and clarify conditions for private sewer and other utilities in areas without county sewer service.
