Commission members moved and seconded the measure after months of edits to a draft policy. The recommendation includes a requirement that mural applicants submit a proposed timeline as part of a two-step review; the commission discussed using conditional approvals tied to that timeline and noted enforcement would follow existing municipal channels. "Once the agreement is signed and received, the city will provide a notice to be posted at the mural site 14 days in advance of commencing the project," staff member Sarah said during the meeting.
Commissioners debated whether to include a formal sunset or completion date in the policy text itself and concluded the application and the post-approval agreement would be the appropriate places to set and enforce completion timelines. Commissioners noted that enforcement for noncompliance would likely be handled as a municipal civil infraction or public-nuisance process, with final language to be reviewed by city legal counsel before the agreement is finalized.
The commission also considered whether to require maintenance plans from property owners of previously installed (grandfathered) murals; members agreed the ordinance does not currently require a maintenance plan for grandfathered works but that noncompliant or deteriorated murals could be handled through nuisance enforcement.
The motion to include the fee and the notice criteria in the packet forwarded to city council was moved by Auggie and seconded by Kathy. The clerk recorded unanimous yes votes from the members present. The recommendation now goes to Petoskey City Council for final consideration and adoption.
Next procedural steps: staff will draft the final recommended language (including the application timeline/conditional-approval language) for council review and legal counsel will review any enforcement language included in the applicant agreement.
