Frank Schneezy of Legacy Development presented a site plan for a 160-unit apartment development submitted after a rezoning. He told the board the plan would include four buildings of 40 units each and a new roughly 3,200-square-foot community building, and that four variances were identified at pre-application: lot area, unit count (proposal 160 units vs a listed code maximum of 73), building height (proposal 50 feet vs a 35-foot maximum), and parking (code required 328 spaces; the plan provides 212).
Schneezy said a planning-department interpretation that the east side of the property counts as the frontage changed several calculations and likely triggers additional variances. He also described prior consideration of off-site overflow parking at an adjacent mall, which the mall could not permit because of existing leases.
Board members raised questions about fire-truck access, snow removal, and the practical use of garage spaces. One board member noted that many garage spaces may not be used for vehicles and could reduce the effective parking count; Schneezy replied that management of parking demand was an issue for the developer to address.
A motion to approve the site plan was called but failed; the chair said the vote constituted a recommendation to deny the site plan. The transcript records the motion failed on a voice vote and that the project would be treated as recommended for denial by the board. The applicant may pursue variances or revised plans.
