Context: The ordinances and the related administrative materials were presented by municipal planner Gabe Baylor and the borough’s housing attorney, Jessica Almeida, as necessary to meet a state-determined deadline (March 16, 2026) and to retain immunity from builder-remedy lawsuits through 2035. Planning board consistency reviews occurred Feb. 23 prior to adoption.
The council took the votes after a public hearing that included a question from resident Jeff Best about access to the Nell property and whether the actions amounted to spot zoning; borough staff and counsel described the statutorily prescribed redevelopment study and planning-process steps.
