"SB 1115 adds sections 9032 and 9033 to the California Health and Safety Code and allows for two things," a county staff presenter said, explaining the statutory changes the bill would make.
Supervisors framed the measure as a narrowly scoped tool to address failures of trustee governance. "We encountered the fiasco of the Tulare Cemetery District," Supervisor Micari said, urging support so the county has a way to remove and replace trustees who are failing to carry out duties. Several supervisors said the mechanism should be available as an opt-in model to other counties but emphasized the immediate local benefit.
Supervisor Macarro moved to sponsor the bill; Supervisor Townsend seconded and the motion passed 5-0. County staff said the change is intended to preserve service continuity for public cemetery districts and reduce lengthy removal procedures. The board did not amend the language on the floor; the sponsorship vote authorizes staff to coordinate with the bill’s author and the state senator carrying the measure.
