Smyrna staff told council they have begun deploying professionally calibrated sound‑level equipment after a judge ordered maximum daily fines for Crown Enterprises over ongoing lighting and nuisance violations at the Lake Farm site.
Town manager Dave reported that the judge’s recent order applies maximum penalties for each day Crown remains noncompliant on lighting and other nuisance matters. Staff described efforts to find a cost‑effective, defensible approach to measure noise in the field and said the calibrated instrument arrived this week and will be placed at the site to log decibel levels under the zoning ordinance. Officials said that while there is a general municipal nuisance code, the zoning ordinance provides district‑specific decibel thresholds that apply at the Crown location.
Legal counsel has notified Crown’s local attorney and staff said they will pursue higher‑court injunctive relief in chancery court if Crown fails to abate nuisances. The town also confirmed Crown cleaned up tree debris and remains under active enforcement monitoring.
What comes next: staff will share measurement results with council and, if necessary, seek injunctive relief to obtain abatement.
