Carey also noted that staff "does not recommend approval due to a self imposed hardship." He summarized a public comment from a nearby property owner (Massey) who expressed concerns that the truck stop might harm resale value.
Barbara Peck of Love's Travel Stops, the applicant, said Love's evaluated site alternatives and identified constraints including where the power company would allow service and the location of underground fuel lines. "It's our hope to be able to bring this amenity to the traveling public, in partnership with GDOT and their NEVI program," Peck said, adding that the canopy would provide weather protection and wayfinding for EV drivers.
Panel members questioned staff about whether the site plans showed the setback and asked how the encroachment agreement affected placement. Carey explained the encroachment permits structures in the easement and that, absent that agreement, the canopy would have to be built 60 feet from the property line. Board members repeatedly observed the proposed canopy sits well back from Highway 17 and several said they had no objection to the location.
After closing the public comment period (no speakers), a committee member moved to approve ZV26-52766 "as presented." The motion was seconded and the panel approved the variance; the transcript does not record a numerical vote tally or ballot-by-name count.
