The Truth or Consequences City Commission on Monday approved a conditional use permit to allow a shipping container and storage on a property without a principal dwelling at 1107 North Bosque.
Planner Miss Alvarez told the commission the applicant is requesting the permit to allow a shipping container and storage on a property that has operated without a main dwelling prior to the city's shipping container ordinance. “We did have a public hearing held on April 13. We’ve had no opponents or proponents. P and Z board did motion for recommending approval, and it carried unanimously,” Miss Alvarez said.
Commissioners asked staff to clarify how the permit applies to future owners. City Manager Whitehead said the conditional use is issued to the current owners and does not run with the deed: “It’s being granted to the current property owners. It’s not a condition that’s gonna continue with the deed on the land,” he said, adding that the code requires annual review by the planning and zoning department.
Chair (speaking from the dais) described this as one of several previously grandfathered shipping containers and noted staff and Planning & Zoning had recommended approval. After a motion to approve by a commissioner and a second, the clerk recorded unanimous affirmative votes and the motion passed.
The permit includes the condition that the storage container must be removed if ownership transfers and that the property owner must return annually for review to ensure conditions remain satisfied. The commission did not hear any public opposition during the Planning & Zoning hearing or in the meeting packet materials.
Next steps: staff will complete permit paperwork and implement the annual review process through the planning department.
