At the May 12 meeting the council considered and approved a motion to allow a sewer-connection exemption for property described in the motion as Lot A of BLA 2022-378, serving property contiguous to the city and its urban growth area. A council member read the motion on behalf of staff; the motion included conditions that all findings required by Leavenworth Municipal Code (LMC) 13.68.020 be satisfied, that an agreement not to protest annexation and an agreement to participate in future local improvement districts or other financing mechanisms be prepared and approved by counsel, and that the exemption not take effect until the agreement is recorded with the Chelan County Auditor.
Staff said the request followed legal counsel direction because the process for sewer exemptions under "Title 13" is not entirely clear, and asked the council to authorize a motion so staff could prepare a resolution with the required findings. The motion was seconded and passed unanimously; the transcript records the council's vote by a show of hands.
Why it matters: Granting an exemption allows a property owner to connect to city sewer service even though the property is contiguous but outside city limits; the approval is contingent on findings and recorded agreements that protect the city's annexation and financing interests.
Next steps: Staff will draft a resolution containing the required findings and the agreements referenced in the motion and return it for formal council action and recordation with Chelan County.
