Shiawassee County authorizes participation in national opioid settlements and allocation plan

The Shiawassee County Board of Commissioners on Aug. 13, 2025 approved two resolutions authorizing the county to enter participation agreements for multiple national opioid settlements and to execute a Michigan state-subdivision allocation agreement that allocates settlement funds on a 50/50 basis between participating local governments and the State of Michigan.

Resolution #25-08-14 addresses the proposed Purdue/Sackler settlement and related allocation arrangements. The resolution’s text describes the proposed settlement terms as including an agreement that the Sackler Family Defendants would pay $6.5 billion over the next 15 years and that the Purdue estate would contribute approximately $900 million; the resolutions reported that the bulk of those payments would be dedicated to funding abatement and prevention strategies. The county also recorded that it previously executed participation agreements for Distributor, Janssen, Teva, Allergan, CVS, Walmart and Walgreens settlements.

Resolution #25-08-15 authorizes participation agreements with additional manufacturer defendants (Alvogen, Amneal, Apotex, Hikma, Indivior, Mylan, Sun Pharmaceutical and Zydus). The resolution summarizes the material payment terms reported in the proposed national agreements, for example: Alvogen — $18,680,162 in a single year; Amneal — $71,751,010 over ten years; Apotex — $63,682,369 in a single year; Hikma — $95,818,293 over one to four years; Indivior — $38,022,450 over four years (and an agreement not to manufacture or sell opioid products for 10 years as described); Mylan — $284,447,916 over nine years; Sun Pharmaceutical — $30,992,087 over one to four years; Zydus — $14,859,220 in a single year. Several settlements also include non-monetary terms such as limits on marketing and requirements to monitor and report suspicious orders, and some permit states to receive free pharmaceutical products or cash in lieu of product.

The board authorized execution of the participation agreements and a Michigan State-Subdivision Agreement for allocation substantially similar to the proposed document available at nationalopioidsettlement.com, and authorized the Weitz & Luxenberg law firm to vote on Shiawassee County’s behalf in favor of the Purdue bankruptcy plan. The motions carried on a 6-0 roll call vote.

The resolutions describe the settlement terms as reported in the proposed national agreements; the amounts and non-monetary terms are those described in the resolution text and public materials for the national settlements. Implementation and actual distributions will depend on execution of participation agreements and statewide allocation procedures.
