Commission rejects special-exception request for fuel facility at 466 and Rolling Acres Road

Growth Management staff described the concept (staff noted a maximum of 5,200 gross square feet and up to 14 fueling positions could be written into the ordinance) and said the property owner is CLD Properties LTD and the applicant is represented by attorney Jimmy Crawford. Jimmy Crawford and traffic engineer Jane Caldara explained that the plan includes right‑of‑way dedication along Rolling Acres Road and preliminary turn‑lane geometry; Caldara said the dedication would provide about 110 feet of total right‑of‑way in places and a turn-lane length that could stage about 20 vehicles (assuming ~25 feet per car).
Commissioners pressed the applicant on staging and potential backup impacts to Rolling Acres Road and County Road 466; the applicant said it expects the operation to be a 24‑hour convenience store with fueling and described security measures and cameras. A nearby property owner association (the Summit Medical Park Owners Association) registered opposition and commissioners raised concerns about queuing, left‑turn conflicts and whether gasoline pumps were appropriate at that last large corner parcel.
An initial motion to approve died for lack of second; a subsequent motion to disapprove passed on roll call. Recorded votes were: Commissioner Reagan — Yes; Commissioner McLean — No; Commissioner Roberts — Yes; Commissioner Sage — Yes; Meredith/Mary Ed Raymond — No. Because the commission voted to disapprove, the special-exception request will not move to final approval in its current form. The applicant and staff said they are available to discuss further mitigation and design options but no final site plan was approved.
