The commission noted the participation agreement provision and that the RDA board historically has discretion to deny refunds when deadlines are missed. Commissioners authorized staff to prepare and send a response and suggested involving legal counsel to review the contractual deadline and any equitable remedies.
Staff will draft a short, nonpersonal response and consult the county attorney before finalizing. The commission moved, seconded and approved authorization for staff to respond.
