Staff outlined multiple code sections relating to development permits, grading, and soil conservation and noted that permits had been rejected or not issued for the work on site. Staff presented aerial imagery and photographs showing the property condition and recommended the board find the respondent in violation.
Franz Dutas, who identified himself as the owner, said his problems stemmed from a builder (Westmont Homes) that he alleges did not secure approvals, removed a large oak tree and performed work inconsistent with permits. Dutas said he had initiated a demand letter against the builder, was still financial responsible for a construction loan, and requested a 60–90 day remediation period to line up contractors. Staff and the board discussed regrading, sodding and restoration steps required for compliance.
A motion to find the respondent in violation, order correction by June 15, 2026, and set fines of $150 per day for noncompliance beyond that date passed unanimously. The board noted restoration plans and coordination with public services staff would be needed to verify compliance.
