Livingston council adopts ordinance regulating fences, including sight-triangle provisions

The City Council of Livingston, Texas, on Jan. 13 adopted Ordinance No. A-857, adding Section 10-30 to Article II of Chapter 10 of the City Code to regulate fences within city limits.
At a public hearing opened by Mayor Judy B. Cochran, Community Development Coordinator Scott Rayburn and City Attorney Scott Ferguson reviewed the ordinance’s key requirements, which the council described as including rules for sight triangles at corners, standards for dumpster enclosures, provisions for structures to be grandfathered, and consideration of flood‑plain issues. Rayburn recommended placing a diagram showing sight‑triangle limits in the permit application rather than embedding it in the ordinance so the illustration could be updated as needed.
Resident Byron Black spoke in favor of the proposed ordinance during the public hearing; no one spoke in opposition. Resident Toni Lee Wood asked whether existing signs that block traffic — she cited a sign at West and Washington — would be addressed; Mayor Cochran said the Community Development Department would investigate that specific sign.
During council discussion, Alderman Andy Evans raised a request for additional clarification to the definition of the “sight triangle” in Section 1(d) but withdrew that request and moved to approve the ordinance as presented. Alderman Alan Cook seconded the motion and all present voted aye.
The ordinance is captioned "ORDINANCE NO. A-857 AN ORDINANCE OF THE CITY COUNCIL, CITY OF LIVINGSTON, TEXAS, ADDING SECTION 10-30 TO ARTICLE II OF CHAPTER 10 (BUILDINGS AND STRUCTURES) OF THE CODE OF ORDINANCES, THEREBY ESTABLISHING A CODE REGULATING FENCES WITHIN THE CITY OF LIVINGSTON, TEXAS." The council indicated staff will incorporate a permit‑application diagram to clarify sight‑triangle requirements and will monitor flood‑plain implications of fence installations going forward.
The council took the action after closing the public hearing at 5:16 P.M.; the ordinance was adopted by unanimous vote.
