Washington County approves Steel National development agreement; fog‑lighting language to follow

Washington County commissioners on May 11 approved a development agreement with Steel National following a Planning & Zoning presentation and discussion about ingress/egress, lighting and state jurisdiction over turn lanes.
Planning & Zoning Administrator Bridget Felmley reviewed an updated site plan for the rezone and development, which shows phased uses including a service station, mini‑storage, an event center and supporting commercial lots. Felmley said the developer agreed that a Certificate of Occupancy will not be issued until required highway work is complete.
Commissioners raised concerns about a clause requiring the developer to "purchase and install fog lighting to ensure that travel along the Highway 95 corridor adjacent to the property is safe, even during times of fog." Prosecuting Attorney True Pearce advised that if the lights were to be in Idaho Department of Transportation (ITD) right‑of‑way, they would have to meet ITD standards and that the county should consider adopting a specific standard to make the requirement enforceable. "If the fog lights are going to be on the State right‑of‑way, then ITD would have to meet ITD standards," Pearce said. Sheriff Matt Thomas said national guidelines for lighting and fog conditions are used by ITD.
Commissioner Nate Marvin suggested adding a reference to National Highway lighting standards (or ITD guidance); Felmley agreed to insert the language and return the revised agreement for signature. The Board then voted to have the Chairman sign the Development Agreement with Steel National Agreement, LLC as of May 11. Felmley noted she would also correct a dated signature page prior to execution.
