Commissioners sign Steel National development agreement after tightening fog-lighting language

Weiser, Idaho — The Washington County Board of Commissioners authorized the chairman to sign a Development Agreement with Steel National Agreement, LLC on May 11 after staff and legal counsel recommended clearer language on fog lighting and standards for work in the state right-of-way.
Bridget Felmley, Planning and Zoning Administrator, walked commissioners through the revised development agreement and attachments reflecting new ownership and an updated site plan that includes a service station, mini storage, an event center and provisions for turn lanes and lighting. The contract as drafted requires the developer to "purchase and install fog lighting to ensure that travel along the Highway 95 corridor adjacent to the property is safe, even during times of fog."
Prosecuting Attorney True Pearce cautioned that fog lighting installed in an Idaho Department of Transportation (ITD) right-of-way would need to meet ITD standards and that an obligation phrased as "safe during times of fog" may be legally vague. Pearce advised the Board that specifying a recognized standard would improve enforceability and suggested referencing national lighting guidelines or ITD requirements. "If the fog lights are going to be on the State right-of-way, then ITD, would have to meet ITD standards," Pearce said. Sheriff Matt Thomas noted ITD follows "the National Guidelines for lighting, fog lighting." Commissioners asked staff to incorporate a clear standard; Felmley agreed to revise the language and correct the signature-page date.
After that clarification, Commissioner Nate Marvin moved and the Board voted to have the chairman sign the Development Agreement as amended; the motion carried.
The agreement ties completion of certain highway improvements to the issuance of a Certificate of Occupancy and requires the developer to work with ITD and the county on turn lanes, lighting, and other traffic-safety measures. Felmley told commissioners she would bring the revised contract back to the clerk to be signed.
No monetary appropriation was recorded with the agreement vote; funding and inspection responsibilities remain subject to ITD coordination and later permit approvals.
