Hearing on Watson Ford No. 25 drainage project continued after counsel raises representation concern

County legal counsel told the Delaware County Board of Commissioners that one property owner appearing at the final hearing for the Watson Ford No. 25 drainage improvement project believed she was not permitted to be accompanied by an attorney. Eric Hostetler, deputy administrator and general counsel, said he had a concern about the owner’s access to counsel and recommended the board continue the hearing so the participant could be fairly represented.
The board opened the hearing briefly at 10:10 a.m., then adopted Resolution 26-354 to continue the final public hearing to Monday, Aug. 3, 2026 at 10:30 a.m. The motion passed by voice vote. Commissioner Jeff Benton said the decision to reschedule was disappointing for those who had adjusted schedules to attend but appropriate to ensure fair representation. Hostetler referenced the Ohio Revised Code in noting the right to representation at administrative hearings.
The continuance pauses the board’s final decision on the Watson Ford No. 25 drainage improvement project until the rescheduled hearing.
