Mills County nullifies Clerk of Court renovation bid after bids omitted ADA compliance

The Mills County Board nullified the bid award for Clerk of Court renovations after staff reported that bids did not account for ADA-compliant repairs to restrooms.
Amber Farnon told the board the county must nullify the bids because major bathroom repairs would require ADA compliance and the current bids did not include that work. “We’re gonna have to nullify the bids that we had due to the fact that any repairs or maintenance that we do to those, like, major repairs to the bathrooms have to make them ADA compliant and our bids did not include that,” she said.
Committee member (S4) moved to nullify the bid award; the motion was seconded and approved by voice vote. Farnon said county staff will work with the district attorney’s office to rewrite the bid package and determine whether engineering or architectural input is required before reissuing the solicitation.
Board members did not adopt an alternate construction plan at the meeting and instead directed staff to return with revised bid documents that include ADA scope and any structural work identified by engineers or architects.
