DOE says HB 3 09 updates autism services and includes ABA principles in school instruction

House Bill 3 09, introduced with an amendment, would revise code relating to services for students with autism spectrum disorder, add a data-analysis and reporting provision, and update the Statewide Monitoring Review Board membership to allow a parent representative. The chair said the bill originated with the Department of Education and she deferred questions accordingly.
Mary Whitfield (Department of Education) told the committee the bill addresses educational programming; she said Applied Behavior Analysis (ABA) principles are foundational to the instruction DOE supports in classrooms and that IEP teams determine whether additional ABA therapy or services are needed. Whitfield also said DOE offers professional learning and workshops for teachers and families.
Committee members asked for clarification whether the bill refers to curriculum or to therapy; Whitfield said the bill covers educational programming at the classroom level and that IEP teams can identify extra therapy when appropriate. No in-person public comment was recorded for HB 3 09 during the meeting, and no committee vote was taken.
