Council hears explanation of PUD modification for Moss water treatment site

Council President opened the pre-meeting on May 19 and the agenda included an ordinance to consider a modification to a previously approved planned unit development at 1879 Conception Street Road.
Planning staff explained that the site is governed by a planned unit development (PUD) and, because PUDs are site-plan specific, any modification must return to the planning commission and the council for approval. "This site is a planned unit development... they're adding 2 electrical buildings," the planning staff said, noting the changes prompted the need for formal review. The staff added that the site’s prior PUD overlay does not conform to the current Unified Development Code and that returning the modification to public review gives residents an opportunity to weigh in.
A councilmember asked for clarification about the number of considerations and the need to bring the modification forward; planning staff confirmed the change is required precisely because the PUD is site-plan specific and the proposed additions do not adhere to current code requirements. "Under the new [UDC], you don't have to have a PUD in place to develop multiple buildings on a site," the planning staff said, "but because this was an overlay that didn't comply with previous zoning requirements, we carried it forward so the public would have an opportunity to weigh in."
The council did not take a final vote on the modification during the pre-meeting; the item was introduced for further review by the planning commission and the council. The administration and planning staff said they would provide additional details as the item proceeds through the formal review process.
