Chair Jeff Johnson told the Criminal Law Subcommittee that Senate Bill 428 is a cleanup measure that clarifies the state’s expungement law so it does not broadly prevent expungements for unrelated convictions. Johnson said the change restores the intended limitation that recent bad-check convictions (within 10 years) should prevent expungement for that offense. The subcommittee ordered a favorable report by roll call; the senate had passed the bill unanimously earlier.
There was no extended public testimony on S.428 during the subcommittee hearing. With the favorable report, the bill moves forward in the legislative process for further consideration.
