Committee staff presented two sets of Department of Public Health regulations and the panel voted to carry both rule packages over for additional review.
Regulation 5407 addresses in-home care organizations and personnel, proposing updates to background checks, drug testing for organizations and staff, client records and client rights; staff said the in-home care space has proliferated (about 1,300 organizations referenced) and that the rule had not been updated since 2014.
Regulation 5408 concerns licensing for hospitals and general infirmaries and was updated to reflect statutory changes enacted in 2024 (including bills addressing acute-hospital care at home and emergency services staffing requirements). Staff noted the House requested striking a sentence about placement of beds and recliners in corridors and similar spaces, and that some material was removed in resubmission to align with statutory developments.
The committee voted to carry both rule packages over; members asked staff for periodic updates and to track any further responses to published fiscal/impact statements.
