Pine County adopts ordinance requiring hemp edible beverages be kept out of general access

The Pine County Board on May 5 adopted Pine County Ordinance 2026-19, amending local rules for retail sales of lower-potency hemp edible beverages.
County Administrator Kelly Schroeder reviewed the board’s April 7 amendment history and said concerns raised then—principally youth access to beverage products marketed like conventional drinks—prompted a new amendment addressing where those products must be stored. The board discussed storage options including keeping such products behind the counter or in another controlled area not accessible to the general public, and considered compliance timing for already registered businesses.
Vice Chair Nelson opened the public hearing and, receiving no testimony, closed it. Commissioner Hallan moved to adopt Ordinance 2026-19; Commissioner Ludwig seconded. The motion passed with three votes in favor and one abstention: Vice Chair Nelson and Commissioners Hallan and Ludwig voted yes; Commissioner Waldhalm abstained. The ordinance requires businesses whose primary product offerings are not age-restricted to store lower-potency hemp edible beverages behind the counter or in another controlled area. Businesses that had already registered prior to adoption must become compliant at their next county registration renewal on January 1, 2027.
