Defense lawyers urge delay on public‑defender restructuring bill despite author’s assurances of cleanup

Tiffany Simpson of the Office of State Public Defender described House Bill 1005 as primarily a technical cleanup to separate the oversight board from the state public‑defender office, clarify contracting relationships and remove outdated references after previous reorganization. "The vast majority of what goes on in this legislation is cleanup," she told the committee, while noting the bill also makes substantive changes to appointment and compensation language.
Jennifer Cameron of the Louisiana Association of Criminal Defense Lawyers told senators that while much of the measure is technical, the bill’s substantive portions—particularly removing the board’s approval of the state public defender, repealing the statutory prohibition on reducing district public‑defender compensation, and formally classifying district public defenders as independent contractors—warrant more stakeholder input and time. She asked the committee to defer the bill to allow working sessions with affected district defenders and to preserve board approval and statutory salary protections.
Vice Chair Harris said he would work with the author and stakeholders to address the concerns raised, but he and others indicated the bill would likely come out of committee. After discussion, the committee reported HB 1005 favorably while recording commitments to continue conversations to resolve the outstanding issues.
