House Bill 1082, introduced on behalf of the town of Boyce, sought to require the Municipal Police Employees’ Retirement System (EMPERS) to bring enforcement actions in the parish where the employer is located rather than centrally in East Baton Rouge Parish. Sponsor testimony said the change would reduce travel and legal burdens on small municipalities and restore a sense of fairness in venue.
EMPERS representatives and counsel opposed the bill, saying centralized litigation in the 19th Judicial District Court allows development of specialized expertise, consistent interpretation of retirement statutes, and efficient handling of repeated, technical procedural motions. EMPERS’ witnesses said centralized handling already permitted consolidated schedules and consistent rulings and that litigation costs and enforcement are shared within the retirement system. EMPERS’ counsel also described extensive settlement efforts and ongoing proposals to resolve disputes administratively.
After a lengthy exchange about settlements, enforcement methods and the fiscal consequences for small towns, the committee adopted an amendment (set 3637) to narrow the change so it applies when EMPERS is the plaintiff: those EMPERS‑initiated actions would be required to be filed in the parish where the cause of action arises. With that amendment adopted, the committee reported HB1082 with amendments.
