The Grundy County Zoning Board of Appeals voted to forward a positive recommendation with conditions on case 25ZBA023, a request to operate a seasonal special‑events venue at 3285 Cemetery Road, to the Land Use Committee.
County staff presented a packet with 26 proposed conditions addressing hours (operations and amplified sound and lighting ending at 11 p.m.), a maximum occupancy of 200 people per event, limits on the number of events (an estimated 10–20 per year), on‑site parking and professional valet/parking management for larger gatherings, security staffing for events exceeding 75 attendees, and compliance with fire, building, health and liquor regulations. The staff recommendation emphasized that the event permit is separate from the property’s existing short‑term rental license and that enforcement mechanisms exist to suspend or revoke a conditional use if violations occur.
Applicant Randy Pertler and property representative Dean Batagowski said the property is about 10 acres and set well back from Cemetery Road. Pertler described steps the operators have taken after earlier problems with the short‑term rental: "We now have identified a really good, noise detection system… so we will know every decibel at any time day or night," he said. The county sheriff told the board that prior issues prompted additional measures such as attendance limits, cameras and security and that, based on the applicant’s revised plan, he was satisfied to give the proposal a chance.
Neighbor Dwayne Cobb said he was bothered by past events that ran into the early morning and asked whether 10 p.m. would be a more reasonable cutoff than the proposed 11 p.m.; the applicant replied that the special‑use controls (including security and monitoring) should reduce the risk of late‑night disturbances. The board voted to forward the conditional recommendation to Land Use; Land Use will review the record on March 25 before the County Board considers final action on April 14.
