The Danbury City Council voted on July 1 to enter executive session to discuss pending tax-appeal litigation involving Herstead (Erstat Biddle) Properties, a shopping center located at 15–19 Backus Avenue.
The motion to enter executive session was made and seconded; the council approved the move by voice vote and recessed at 8:17 p.m. The council instructed Dan Garrick, director of finance; Donna Murphy, the tax assessor; Taylor O’Brien; and members of the corporation counsel’s office and outside litigation counsel to remain for the session.
The clerk read a brief summary of the case and said the recommended settlements had reached a stage acceptable to both plaintiff and the assessor following extensive negotiation and court involvement. The council did not disclose details of the settlement in open session and moved the discussion to executive session, as permitted for pending litigation.
