"In regards to the 99 year easement with ADM to sequester CO2 under Lake Decatur, there's been reports that ADM Is redacting diagrams of the CO2 plume," Horn said, asking whether the easement allows sequestration before EPA permits and whether prior sequestration could be grounds for rescission of the agreement.
Legal and administrative staff responded that permit compliance is the primary issue. "They have to follow any and all permitting agencies and their regulations, and that would certainly include U.S. EPA," said city legal/administrative staff. Staff noted that questions about rescission or litigation have potential legal ramifications and would not be discussed in open session.
No council action or vote occurred on the easement at the meeting; staff indicated that federal permitting and EPA compliance would be central to any inquiry and that further, potentially confidential, legal analysis would be required before any course of action.
The discussion flagged a potential environmental and regulatory issue that council said would be pursued through appropriate administrative and legal channels if warranted.
