Town asks magistrate to vacate lien order after ownership error for 5531 Astera Boulevard

Michael Hausman, code enforcement manager for the Town of Fort Myers Beach, told Special Magistrate Monica Schmucker that staff found an error in the property ownership in a prior special magistrate order dated Oct. 17, 2025, related to a lien certification for 5531 Astera Boulevard.
Hausman said the incorrect property had been cited and that no fines were run on the prior case; the town requested the magistrate vacate the earlier order and administrative costs of $250. Magistrate Schmucker agreed to review and vacate the order and said she would issue an order noting the vacatur and referencing the prior case.
The magistrate did not indicate additional penalties; the town framed the request as a correction to the record because the previously cited property ownership was found to be incorrect.
