Owner Mark Doran addressed the commission and described long family ties to the neighborhood and prior renovations across his parcels. Doran said he was unaware the patio needed permitting: “We didn’t know that we did anything wrong,” he told the commission.
Staff explained the enforcement order provides the owner two options: remove the unpermitted structures by the order date or submit an after‑the‑fact Notice of Intent (NOI) and pursue mitigation plantings or other permit requirements. Commission members recommended the after‑the‑fact filing as the practical path and clarified that staff would send a checklist of required documents (survey, site plans and mitigation proposals) to help the owner complete a filing.
The commission voted to issue the enforcement order with those options; staff said they would follow up with the owner directly and provide guidance for filing an NOI if he chooses that route. Members emphasized there was no evidence of malicious intent but that permitting pathways must be followed to resolve the compliance issue.
The enforcement order sets firm next steps and a deadline for compliance; if the owner does not pursue permitting, removal remains an available remedy under the order.
