Board carries Meek Street pool variance after finding as‑built pool and equipment off the approved plan

The Springfield Township Board of Adjustment on May 19 deferred action on a variance request for a pool at 53 Mix Street (Meek Street) after board members determined the as‑built pool and filter equipment do not match the originally permitted plans.
Applicant Lynn Bances told the board the contractor installed the inground pool on the wrong side of the yard and that the family has been living with an unfinished site and a legal dispute with the contractor for about two years. "Moving the pool will create a significant financial hardship," Bances said, asking the board to consider variance relief and noting she had passed town inspections during construction.
Board members reviewed an "as‑built" plan that shows the pool placed nearer to the side and rear property lines than the approved design and noted existing patios and an outdoor kitchen were not removed as originally planned, which keeps lot coverage high. A planner and board members noted the pool and equipment now sit well inside the 15‑foot setback the ordinance requires and that the pool equipment is approximately 2 feet from the property line.
The chair said the board could not grant jurisdiction over certain code waivers (for example, alarms) and urged the applicant to coordinate with building and code officials before returning. One board member said the application, as presented, was not acceptable: "As it sits before me right now, I'm not going to be in favor of approving this this evening." The board advised the applicant to submit revised engineered plans showing any removed patios, the final equipment location, and a reduced lot‑coverage proposal.
After discussion, a motion to carry the application to the June 16 meeting passed. The board recorded that members who voted in favor were present at the meeting and the continued hearing serves as public notice for the June date.
