Cutler Bay officials say soil testing delays have slowed Legacy Park remediation; vertical work and bids continue

Emma Jones, a Stantec project manager, told the Town of Cutler Bay council on May 20 that phase 1 of the 16‑acre Legacy Park and Municipal Complex remains under review as the town awaits Miami‑Dade County Department of Environmental Resources Management clearance for the contractor’s final soil‑remediation plan.
"Phase 1, which is GMP 1 site remediation, we are still awaiting DERM's approval for our final plan on all of the soil approvals," Jones said, noting the team expects that approval by the end of the month.
Town Manager Ralph Casals said the additional review followed conflicting sampling results in a small number of points and that the town has been coordinating closely with county staff. "There was a couple of wells that there was some conflicting data," Casals said, and more sample points were taken to resolve discrepancies.
Despite the pending clearance, Stantec and town staff said construction activity and long‑lead procurement can continue. Jones said Kaufman Lynn is under contract for GMP 2 and a job trailer and truck‑wash station are on site; drawings for GMP 3 (the vertical build) were issued on May 14, and bids are due June 8, with RFIs due May 27 and responses expected by June 2.
Council member Duncan pressed staff on the length of the DERM review. "It seems to be a little excessive," Duncan said, asking whether similar projects experience comparable delays. Jones and Casals replied that extra sampling and verification were necessary because arsenic concentrations in isolated areas required re‑testing and documentation before county clearance.
The town said value engineering remains ongoing across the project while permitting and bid finalization proceed. No formal change to the project budget or completion date was announced at the meeting.
Next steps: the town and consultant expect DERM’s clearance by the end of the month, Kaufman Lynn will finalize GMP‑2 buyouts, and the town will evaluate bids for GMP‑3 after the June 8 deadline.
