Local landowner: Summit Carbon Solutions withdraws some Iowa segments; landowners should review easements, speaker says

Jen Norris of West Township delivered an update on the Summit Carbon Solutions pipeline project and urged landowners to remain vigilant.

"Summit had filed a notice of intent to withdraw certain segments with the Iowa Utilities Commission," Norris told the board, adding that the filing would eliminate routes south of Crawford County—including Montgomery, Adams, Page, Fremont, Shelby, and Pottawatomie counties. She said, as submitted, about 200 miles in Iowa are projected to be removed, while a remaining route of roughly 800 miles would remain north of Interstate 80.

Norris explained the legal status is still unsettled: a district court remanded an appeal of Iowa's conditional permit back to the Iowa Utilities Commission, Summit has filed amendments asking not to be required to declare a final route or destination, and permits for sequestration are not in place. She warned that even if routes are withdrawn, signed easements may remain enforceable and could be assigned or sold to another project. "Unless otherwise stated in the signed document, those easements can be forever," she said, and recommended landowners seek qualified legal advice to understand specific contract terms and any sunset clauses.

Norris urged counties to use the apparent pause as an opportunity to evaluate or adopt ordinances while the project's scope is changing, but she cautioned that the pause does not eliminate the company's legal options. Board members asked whether easements in Page County could be unwound; Norris said that depends on each contract's language and recommended legal consultation.
