Jefferson County approves conditional use permit for boat and RV storage on 43rd Street with culvert condition

The Jefferson County Board of Commissioners voted April 27 to approve a conditional use permit (CU2026-01) to allow a boat and recreational-vehicle storage facility on 43rd Street, after county staff concluded a protest petition against the project was valid and therefore required a unanimous three-commissioner approval.
Community Development Director Stephan Metzger told the board that staff determined the appropriate method was to count only properties within the 1,000-foot boundary around the proposal, which made the petition valid and raised the threshold for approval to a 3-of-3 vote. Metzger said the applicant provided an updated site plan and cautioned that the plan may need changes during the building-permit process.
Metzger proposed an eighth condition addressing stormwater and access: “prior to the installation of the extended culvert, the applicant shall work with Road and Bridge to establish the exact location of the approaches and ensure that no part of the culvert or approach is outside of the right-of-way of 43rd Street outside of the established access easement along lot 1 of Ferguson Heights or encroaches upon the United States Army Corps of Engineers property.”
Ben Domann, who discussed options with the applicant on-site last week, reported that from the Road and Bridge perspective he had no issues with the approach as discussed. A person identified in the minutes as Mr. Miller met with Domann on site to review options related to the approach and culvert.
During public comment, Dan Foltz rose to state his disagreement with the project; the minutes record no other members of the public speaking. Commissioner David Christy moved to approve CU2026-01 with the eight proposed conditions; Commissioner Richard Malm seconded and the motion passed with all in favor, meeting the 3-of-3 requirement triggered by the valid petition.
Next steps noted by staff included possible site-plan revisions during the building-permit review and coordination with Road and Bridge on the culvert and approach location before any installation. The board’s approval authorizes the land-use change subject to the stated conditions.
